Terms of Service

1. Acceptance of terms

By accessing or using Kall8 (the “Services”), you agree to be bound by these Terms of Service and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization. If you do not agree, do not use the Services.

2. The service

Kall8 provides an AI voice-calling platform including outbound calling campaigns, appointment booking, reminders and follow-ups, an inbound AI receptionist, telephony, and related features. We may update, add, or remove features over time to improve the Services.

3. Accounts and security

You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account and for your users’ compliance with these Terms. Notify us promptly of any unauthorized use.

4. Acceptable use

You agree not to use the Services to:

• Violate any law or regulation, or infringe the rights of others;
• Send unlawful, fraudulent, deceptive, harassing, or unsolicited communications;
• Place calls without a lawful basis or required consent from recipients;
• Transmit malware or attempt to disrupt, probe, or gain unauthorized access to the Services;
• Reverse engineer, resell, or misuse the Services outside their intended purpose.

5. Calling and messaging compliance

You are solely responsible for complying with all applicable laws governing calls, recordings, and communications — including telemarketing, do-not-call, consent, and call-recording laws in the jurisdictions you operate in and contact. You must obtain and maintain all necessary consents and honor opt-out and do-not-call requests. Kall8 acts as your service provider and is not responsible for the content or legality of the communications you configure.

6. Billing and payment

The Services are billed on a pay-per-minute basis drawn from a prepaid wallet, plus any applicable fees disclosed in the app. Top-ups are processed by third-party payment providers. Charges for usage are generally non-refundable except as required by law or expressly stated. You are responsible for maintaining sufficient balance for your campaigns to run.

7. Third-party services

The Services integrate with third parties (for example, Google Calendar, AI voice/model providers, telephony carriers, and payment processors). Your use of those integrations may be subject to the third party’s own terms and policies. Our handling of Google user data is described in our Privacy Policy. We are not responsible for third-party services we do not control.

8. Intellectual property

The Services, including all software, content, and trademarks, are owned by Kall8 or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms. You retain ownership of the data and content you upload, and grant us the rights necessary to operate the Services on your behalf.

9. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that AI-generated interactions will be accurate for every situation.

10. Limitation of liability

To the maximum extent permitted by law, Kall8 will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our aggregate liability arising out of or relating to the Services will not exceed the amounts you paid to us for the Services in the three (3) months preceding the event giving rise to the claim.

11. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or as otherwise permitted. Upon termination, your right to use the Services ceases; provisions that by their nature should survive (such as billing, disclaimers, and limitation of liability) will survive. We may update these Terms from time to time; material changes will be posted on this page with a new “Last updated” date.
